1.General provisions

All deliveries and services by mypalletmarket due to on-line orders or any other orders are subject to the following General Terms and Conditions.

Any ambiguous and/or additional agreement should be clearly approved by the management committee or authorized personnel, and must be in written form; this also applies to any waiver of written form requirements. Since our quotation is only applicable to contractors, there is no clear contract or legal right to cancel, and we do not grant the option of returning the received goods, otherwise private customers will be able to return the goods.

2. Terms of delivery

Unless expressly stated otherwise, the delivery date given in the order confirmation is not binding. The delivery date will be respected as much as possible.

Any order after this time can be delivered within two working days after the order date. If there is no delivery within the given time, the customer has the right to set a deadline of at least 4 weeks.

If MYPALLETMARKET does not become effective within the new period, the customer has the right to issue a written notice to withdraw from the contract.

If the service cannot be provided due to force majeure, especially in the case of force majeure, war, industrial disputes or the supplier’s control, MYPALLETMARKET has the right to withdraw from the contract. The customer should be notified immediately that the ordered goods are not available, and any payment that has been performed will be immediately returned to the customer.

3. Passing of risk

Once the goods are transferred to the freight forwarder and leave our warehouse, the risk will be transferred to the customer. This also applies to the case where MYPALLETMARKET bears the transportation costs. The customer should immediately file a shipping damage claim to the freight forwarder or MYPALLETMARKET within the applicable period.

The risk of any goods shipped to MYPALLETMARKET by the customer shall be borne by the customer until the goods arrive at MYPALLETMARKET. In particular, the transportation risk is entirely borne by the customer.

4 .Terms of payment

All invoices from MYPALLETMARKET must be paid immediately without any discount.

Cheques and Bank Transfers are only accepted at the time of clearing.

Any bank charges incurred by cheques payments shall be borne by the customer. If the customer’s claim is not opposed by MYPALLETMARKET or the court law is ultimately binding, the customer can only exercise the right of offset.

If the customer is based on the same contractual relationship, they can only exercise the right of retention. MYPALLETMARKET reserves the right to transfer claims for delivery and achievements for financial purposes. If the customer defaults on payment, all other claims shall be paid immediately without a notice of default.

5. Warranty

If a claim can be found through a reasonable inspection, a claim regarding the scope of delivery, product defects, incorrect delivery and indefinite quantity should be filed in writing immediately-within the last three working days after receipt of the goods.

Dispatch on time is sufficient to meet the time limit. Within these three working days, the warranty period for obvious defects will end.

MYPALLETMARKET provides a one-year warranty for new products from the date of delivery. MYPALLETMARKET does not provide any warranty for second-hand products.

If any defects are maliciously hidden, the above restrictions will not apply. If there are any reasonable claims, MYPALLETMARKET will deliver the missing items, repair the goods or send new products respectively.

6. Liability

If MYPALLETMARKET negligently breaches its obligations, the liability shall be limited to the foreseeable actual damages stipulated in the contract. This should also apply to the minor negligence of MYPALLETMARKET’s substitute agent.

MYPALLETMARKET is not responsible for breach of non-substantial contractual obligations due to minor negligence. The limitation of liability does not apply to customer claims regarding product liability.

The limitation of liability does not apply to customer claims for damage caused by loss of life, limb or health caused by MYPALLETMARKET

7. Reservation of title

Before fulfilling all contractual obligations, any products purchased shall be the property of MYPALLETMARKET. The retention of title shall also apply to all claims made by MYPALLETMARKET against the buyer due to any other services such as purchase or repair after delivery.

During the retention period of ownership, the buyer has the right to own and use the purchased goods as long as he has the right to timely perform his retention obligations and contractual obligations regarding ownership.

The customer is obliged to inform MYPALLETMARKET of all the information required to claim the rights related to the retention of ownership.

8. Data processing

MYPALLETMARKET has the right to collect, store and process all necessary data and information related to the customer required in the process of establishing a business relationship between the customer and MYPALLETMARKET.

9. Severability clause

If any provision of these general terms and conditions becomes invalid or becomes invalid, all other provisions of the general terms and conditions will continue to be valid. The invalid clause should be replaced by a clause that is as close as possible to the economic purpose of the invalid clause.

10. Miscellaneous provisions

The place of performance and jurisdiction for all contracts is the registered office of MYPALLETMARKET. MYPALLETMARKET has the right to take legal actions within the jurisdiction of contracting parties.

11. Cancellations

You can only cancel or modify the order before processing your order, and we cannot cancel or modify any order after the order is processed and sent.

If you really have to cancel an order that has already been booked. We will not refund the deposit. Usually we will charge a deposit of 50% of the goods
